Acceptance of Terms
By using the neftti.com web site (“Service”) or any other service of the National EFT Training Institute (NeftTi), you are agreeing to be bound by the following terms and conditions (“Terms of Service”).
The National EFT Training Institute (NeftTi) reserves the right to update and change the Terms of Service from time to time and will always give notice of changes in its news section and via email. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
You understand and agree that the National EFT Training Institute (NeftTi) cannot be responsible for the Content posted on the Service and you agree to use the Service at your own risk.
Violation of any of the terms below will result in the termination of your Account.
Account Terms
Your Account
You must be 18 years or older to use our Services. Minors under 18 and at least 13 years of age are only permitted to use our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision. Children under 13 years are not permitted to use neftti.com or the services mentioned herein.You are responsible for any and all account activity conducted by a minor on your account, and there may be commercial products or services available that you may want to consider to limit a minor’s access to material online
You must be a human. Accounts registered by any automated means are not permitted.
Be honest with us. Provide accurate information about yourself. It’s prohibited to use false information or impersonate another person or company through your account.
You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
You may not use language that is offensive, vulgar, infringes someone’s intellectual property rights, or otherwise violates the Terms.
Your login may only be used by one person – a single login shared by multiple people is not permitted.
Protect your password. You are responsible for maintaining the security of your account and password. The National EFT Training Institute (NeftTi) will not be liable for any loss or damage from your failure to comply with this security obligation.
You’re responsible for your account.
You’re solely responsible for any activity on your account. If you’re sharing an account with other people, then the person whose financial information is on the account will ultimately be responsible for all activity. If you’re registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.
People You Interact With.
You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person.
Third-Party Services.
Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Mailchimp, Facebook, Linkedin, Instagram, Twitter and Pinterest). You may also need to use a third party’s product or service in order to use some of our Services. When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. The National EFT Training Institute (NeftTi) is not a party to those agreements; they are solely between you and the third party.
Copyright and Content Ownership
We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours.

Your Content
You are responsible for all Content posted and activity that occurs under your account. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
Permission to Use Your Content.
By posting Your Content through our Services, you grant the National EFT Training Institute (NeftTi) a license to use it. We don’t claim any ownership of Your Content, but we have your permission to use it. That way, we won’t infringe any rights you have in Your Content. For example, you acknowledge and agree the National EFT Training Institute (NeftTi) can display blog articles you submit, events you post in community area, directory listing, or testimonials on the Site, from time to time. By posting Your Content, you grant the National EFT Training Institute (NeftTi) a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content. You agree not to assert any moral rights or rights of publicity against us for using Your Content. You also recognise our legitimate interest in using it, in accordance with the scope of this license, to the extent Your Content contains any personal information.
Legal
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
Don’t Steal Our Stuff. You agree not to crawl, scrape, or spider any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.
Don’t Try to Harm Our Systems. You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.
Cancellation and refunds
CANCELLATION POLICY:
Workshop and Training payments are billed in advance and are non-refundable, however up until 2 weeks prior to the event date, they can be transferred to someone else or credited toward the current cost of an upcoming workshop or training offered by NeftTi. If for any reason you can not make it to a training for which you registered, you can send a request to attend a future training opportunity within the next 12 months.
Upon termination of the account, there will be no refunds or credits for partial months of unused service. Any upgrades made during the period of the subscription will be charged pro rata.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only European VAT (if applicable).
Termination
If you choose to terminate your account, all of your Data will remain intact upon expiration of your membership. Only a written request to delete the account Data will result in the loss of the account Data.
Modifications to the Service and Prices
The National EFT Training Institute (NeftTi) reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with prior written notice in its news or blog section.
Prices of all Services, including but not limited to subscription plan fees to the Service, may be subject to change upon 30 days notice from us. Such notice may be provided at any time by email notification.
The National EFT Training Institute (NeftTi) shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
General Conditions
Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
You understand that the National EFT Training Institute (NeftTi) uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, the National EFT Training Institute (NeftTi) ,or any other the National EFT Training Institute (NeftTi) service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by NeftTi.
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service
Failure to comply with the National EFT Training Institute (NeftTi) ’s Code of Conduct, Forum Rules or Terms of Service (Terms and Conditions) could result in immediate account termination.
You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
the National EFT Training Institute (NeftTi) does not warrant that: (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
You expressly understand and agree that the National EFT Training Institute (NeftTi) shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the National EFT Training Institute (NeftTi) has been advised of the possibility of such damages), resulting from:
(i) the use or the inability to use the service;
(ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;
(iii) unauthorized access to or alteration of your transmissions or data;
(iv) statements or conduct of any third party on the service;
(v) or any other matter relating to the Service.
The failure of the National EFT Training Institute (NeftTi) to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and the National EFT Training Institute (NeftTi) and govern your use of the Service, superseding any prior agreements between you and the National EFT Training Institute (NeftTi) (including, but not limited to, any prior versions of the Terms of Service).
Warranties
The National EFT Training Institute (NeftTi) is dedicated to making our services the best they can be, but we’re not perfect and sometimes things can go wrong. You understand that our services are Provided “As Is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade.
We do not guarantee that: (i) the services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) the services will be free of viruses or other harmful materials; or (iv) the results of using the services will meet your expectations. You use the services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.
Liability limits
To the fullest extent permitted by law, neither the National EFT Training Institute (NeftTi), nor our employees, sub-contractors or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the services or these terms. In no event shall the National EFT Training Institute (NeftTi) ’s aggregate liability for any damages exceed the greater of one hundred ($100) canadian dollars (cad) or the amount you paid the National EFT Training Institute (NeftTi) in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.
Indemnification
(or What Happens If You Get Us Sued)
We hope this never happens, but if the National EFT Training Institute (NeftTi) gets sued because of something that you did, you agree to defend and indemnify us. That means you’ll defend the National EFT Training Institute (NeftTi) (including any of our employees and subcontractors) and hold us harmless from any legal claim or demand (including reasonable lawyer’s fees) that arises from your actions, your use (or misuse) of our Services, your breach of the Terms, or you or your account’s infringement of someone else’s rights.
We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.
Release of the National EFT Training Institute (NeftTi). You release the National EFT Training Institute (NeftTi) from any claims, demands, and damages arising out of disputes with other users or parties.
Governing Law
The Terms are governed by the laws of the Province of Ontario, without regard to its conflict of laws rules, and Canadian Laws. These laws will apply no matter where in the world you live, but if you live outside of Canada, you may be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection law.
Disputes with the National EFT Training Institute (NeftTi)
Arbitration
By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.Arbitration, including threshold questions of arbitrability of the dispute, will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction.
Any arbitration or mediation under the Terms will take place on an individual basis. You understand that by agreeing to the Terms, you and the National EFT Training Institute (NeftTi) are each waiving the right to trial by jury or to participate in a class action lawsuit. Class arbitrations shall only be available if requested by either party under its Class Action Arbitration Rules and approved by the arbitration entity. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator or mediator. You may instead assert your claim in “small claims” court, but only if your claim qualifies, your claim remains in such court, and your claim remains on an individual, non-representative, and non-class basis.
Costs of Arbitration.
Payment for any and all reasonable filings, administrative, and arbitrator fees will be in accordance with the Consumer Arbitration Rules, and in the case of CEDR, its rules. If the value of your claim does not exceed $10,000 USD, the National EFT Training Institute (NeftTi) will pay for the reasonable filing, administrative, and arbitrator fees associated with the arbitration, unless the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for an improper purpose. For mediation through CEDR, the parties will pay their share of mediation costs, and under certain conditions such fees may be refundable to you, depending on the outcome of the mediation.
Forum
We’re based in Ontario, so any legal action against the National EFT Training Institute (NeftTi) related to our Services must be filed and take place in Ontario. For all actions the proceedings may be filed where your residence is, or in Markham, Ontario, and any in-person hearings will be conducted at a location which is reasonably convenient to both parties taking into account their ability to travel and other pertinent circumstances. For any actions not subject to arbitration or mediation, you and the National EFT Training Institute (NeftTi) agree to submit to the personal jurisdiction of a provincial court located in Ontario.
Government Exception
If you are a government agent or entity in Canada using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of Canada (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the Province of Ontario.
Modifications
If we make any changes to this “Disputes with the National EFT Training Institute (NeftTi)” section after the date you last accepted the Terms, those changes will not apply to any claims filed in a legal proceeding against the National EFT Training Institute (NeftTi) prior to the date the changes became effective. The National EFT Training Institute (NeftTi) will notify you of substantive changes to the “Disputes with the National EFT Training Institute (NeftTi)” section at least 30 days prior to the date the change will become effective. If you do not agree to the modified terms, you may send the National EFT Training Institute (NeftTi) a written notification (including email) or close your account within those 30 days. By rejecting a modified term or permanently closing your account, you agree to arbitrate any disputes between you and the National EFT Training Institute (NeftTi) in accordance with the provisions of this “Disputes with the National EFT Training Institute (NeftTi)” section as of the date you last accepted the Terms, including any changes made prior to your rejection. If you reopen your closed account or create a new account, you agree to be bound by the current version of the Terms.
Changes to the Terms
We may update these Terms from time to time. If we believe that the changes are material, we’ll definitely let you know by posting the changes through the Services and/or sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes unless otherwise specified. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.
The Terms, including all of the policies that make up the Terms, supersede any other agreement between you and the National EFT Training Institute (NeftTi) regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.
